District court for the southern district of new York decided to hold lifted at the end of April, the Democratic primary in new York, reports Reuters.
Primary elections were cancelled in late April. The election Commission has said that holding primaries in a pandemic coronavirus would be “unnecessary and frivolous” because all opponents are former Vice-President of the USA Joe Biden has already withdrawn from the race and the vote would be a mere formality.
However, the court issued a preliminary injunction on enforcement of the decision of the electoral Commission on the claim of former campaign member, Democrat Andrew young. He believes that the cancellation of the primaries violates the 1st and 14th amendments to the U.S. Constitution (1st amendment guarantees the right to freedom of speech, Assembly and the right to appeal; the 14th guaranteed the equality of citizens and prohibits the enactment of any state discriminatory laws).
According to the court, the vote in the primary elections should pass on June 23.
The Governor of the state of new York Andrew Cuomo said that the authorities execute the court decision, but did not rule out that this ruling will be challenged.
The U.S. presidential election scheduled for 3 November. The main battle for the White house traditionally conducted between the candidates of the two major political forces of the States: the Democratic and Republican parties. Democrats will almost certainly represent Joe Biden (all of his rivals have already dropped out of the race), the Republicans, the incumbent President Donald trump.
