A US court has allowed the first in 17 years, the Federal penalty

The U.S. Supreme court finally allowed to resume the first in 17 years penalty. On that July 14, reports the Associated Press.

On the eve of a Federal U.S. judge Tanya Chutkan issued an injunction that has delayed executions, notes Reuters.

The judge ordered the U.S. Department of justice to delay four executions scheduled for July and August to allow the continuation of lawsuits against convicted new Protocol for lethal injection, announced in 2019. Chutkan noted that according to scientific proofs presented to the court, the Protocol execution of 2019 is likely to cause the plaintiffs extreme pain and unnecessary suffering.

She also added that the prisoners will probably win the lawsuit about the fact that the use for the execution of pentobarbital violates the constitutional ban on “cruel and unusual” punishment.

Chutkan sided medical examiner, which quoted the prisoners. According to him, an injection of pentobarbital at high doses is caustic enough to quickly fill the lungs with blood of the convicted person, causing a feeling like it’s sinking for some time before losing consciousness.

To make their death less painful, the prisoners proposed to add morphine or similar painkillers in lethal injection or arrange for their execution by firing squad.

Trump’s administration asked the U.S. Supreme court to cancel the order Chutkan, calling it baseless and destructive plans to hold a decent and humane lethal injection. The Ministry of justice also challenged the injunction in the US court of Appeals for the district of Columbia.

According to Reuters, efforts to resume the death penalty at the Federal level were made within a few months after the inauguration of US President Donald trump in 2017. The European Union ban on the sale of assets for use in executions or torture has led to the fact that pharmaceutical companies refused to sell such drugs in the penitentiary system of the United States.

The U.S. Department of justice have spent most of 2018 and 2019 on the creation of a secret supply chain of private companies to produce and test their means – pentobarbital – which replaces three of the drug used in previous executions. Some of the participating companies said that didn’t know what they are testing drugs intended for execution. After this, one lab has announced that it will refuse to check pentobarbital.

In 2003, the U.S. government imposed an informal moratorium on executions, as the Ministry of justice decided to revise their Protocol. The moratorium was imposed because of botched executions, where prisoners gasped or moaned before his death that questioned a painless procedure, told the publication USA Today. The last three executions at the Federal level took place in the United States in 2001-2003, when the President was George W. Bush. Before this, the us government executed a person in 1963 under President John F. Kennedy. In 2019 Bbl ordered to resume lethal executions, but the process was blocked due to litigation.

National Public Radio said that now executions in the United States at the Federal level expects more than 60 people, including a native of Chechnya Johar tsarnaev, who was found guilty in the bombing during the Boston marathon in 2013.
